Both houses of the legislature approved the union-backed APPR reform bill that scraps the mandated use of grade 3-8 state tests in teacher evaluations. The bill returns evaluation decisions to local school districts and ensures any teacher evaluation system is subject to collective bargaining. NYSUT will continue its fight to reduce the standardized testing burden on students.

ALBANY, N.Y. Nov. 5, 2018 — New York State United Teachers today released the following statement after the Regents extended the moratorium on tying state standardized test scores to teacher evaluations:
"We welcome the extension of the moratorium and thank Chancellor Betty Rosa and the Regents for continuing to recognize that the state’s over-emphasis on standardized testing has worked for neither students nor teachers. While we welcome the moratorium extension, NYSUT will continue to seek a long-term legislative solution that will return evaluations to local control. Teachers and local school districts know what works best in their own communities." New York State United Teachers today commended the Board of Regents for reversing harmful draft regulations on test participation in order to comply with the federal Every Student Succeeds Act. NYSUT said:
“Parents and educators spoke passionately and the Regents listened. We commend Chancellor Rosa and the Regents for that. As a result of today’s actions, schools with high opt-out rates will be treated more fairly — a victory for the hundreds of NYSUT members who opposed the draft regulations and defended parents’ right to opt their children out without penalty or pressure. While this is an important step forward, our fight is not over. U.S. Education Secretary Betsy DeVos is clearly misinterpreting federal law by requiring the state to identify schools with high opt-out rates. Thank you for making our collective voices heard! Carolyn Richards To the Board of Regents, I am writing to relay strong objections to the treatment of opt outs and collective bargaining rights in the emergency regulations to implement ESSA that are currently in a second public comment period. As professionals in the field, we should follow the ESSA regulations, not impose our own. Parents will continue to opt their children out of NYS testing until they are satisfied that the commissioner makes real change to the current test and punish culture in New York State. The changes to the standards were minor and the tests continue to impose benchmarks/cut scores that are not developmentally appropriate. The opt outs will not decline until this happens. Parents have raised these concerns and teachers are currently in a 4 year moratorium because of the poor implementation. Currently, Commissioner Elia is expecting school districts to provide professional development on the NYS Next Generation Standards until 2021. As a professional educator, I feel it is imperative that the moratorium continue in relation to the consequences of student testing on a teacher's evaluation. 1. Stop punishing districts for a parent's right to opt their child out of NYS Testing. 2. Please follow the regulations set forth by The Department of Education/ESSA. 3.
